This Privacy Policy takes effect on the date shown above.
This Privacy Policy explains how MyAthlete360 LLC ("MyAthlete360 ," "we," " us," or "our ") collects , uses, shares, and protects information about you when you use the MyAthlete360 mobile app for iOS and Android, the website at https ://myathlete360.net , the web app at https://pro .myathlete360.net, and any related features or services (together, the " Services "). It is part of, and uses the same defined terms as, our Terms of Service at https ://myathlete360.net /terms-of-service / (for example, "Parent," "Athlete," "Provider," "Counselor," "Lead," "Ad Board," and "Booking").
1.1 Who we are. MyAthlete360 LLC is located at 3809 S General Bruce Dr, Ste 103, Temple, TX 76502. You can reach us at contact@myathlete36 0.net or 254-278-7799. We are responsible for the personal information described in this policy.
1.2 What we do. MyAthlete360 is a marketplace and advertising platform that helps Parents and adult athletes find local Providers , mainly in Central Texas. We are not a coaching, training, tutoring, counseling , or healthcare provider. Providers are independent businesses, and when a Provider receives your information through the Services , the Provider's own privacy practices also apply to how the Provider uses it .
1.3 What this policy covers . This policy covers information we collect through the Services, and when you email, call, or otherwise communicate with us. It does not cover :
1.4 Replaces the prior policy . This policy replaces all earlier versions of the MyAthlete360 privacy policy.

Users under 18 may create an account only as described in Sections 2.4, 11, and 12.
2.2 Signup role and age band . When you sign up, you first choose how you are registering: Parent/Athlete, Coach/Trainer, Tutor , or Counselor . If you choose Parent /Athlete, you then tell us who you are :
We use your answer (your "age band") to decide what information we may collect, what parental consent we need, and which features you can use . We may also ask for age information (such as a birth year) where needed to keep your age band accurate. Providers must be 18 or older.
2.3 Parent and Athlete profile information. A Parent may create and manage one or more Athlete profiles for their children or wards, and an adult athlete (18 or older) may create a profile for themselves. An Athlete profile may include:
For children under 14, please provide only the minimal information listed above. Do not enter a child's email address, phone number, photo, or school name in a Parent-managed profile.
2.4 Minor accounts (Under 14 and 14–17). Minors may start signup themselves, but a parent or guardian must be involved before the account is fully active:
2.5 Provider profile information . If you are a Provider, we collect the information you put on your profile, such as your name, business name, profile photo, bio, the services you offer, sports or subjects, ages you work with, experience, education, service area, prices, availability, and links to your Instagram, Facebook, website, or other pages.
2.6 Credentials, licenses, and verification . Providers may give us certifications, license type and number, issuing state or agency, expiration dates, proof of insurance, and copies or photos of these documents. We may confirm this information using public license lookups (for example , the Texas Behavioral Health Executive Council). If we ask a Provider to complete identity verification, the Provider may be asked for identity information, which may be collected by us or by a service provider that performs the verification for us .
2.7 Background-check information (if and when offered ). We do not currently run background checks or collect background -check information. See Section 13.
2.8 Payment and purchase information. Card and bank details for Bookings and web purchases are collected and processed by Stripe, and in-app subscription and Lead credit purchases are processed by Apple or Google. We do not receive or store full card numbers. See Section 14.
2.9 Messages . When you use in-app messaging , we collect the content of your messages (including any photos or files you attach, where supported), who sent and received them, and when.
2.10 Reviews, ratings, and reports . We collect reviews and ratings you post, and any reports you make to us about safety concerns, content, or other users, including reports you submit with the Report button in the app (such as the report details, the user or content reported, and when you sent it ).
2.11 Ad Board content and other User Content . We collect the ads, photos, videos (where supported), text, links, and other content that Providers post on their Ad Board or profile, and any other content you submit.
2.12 Bookings and Leads. When a Parent books a session or contacts a Provider, we collect the details of that request, such as the Provider, service, date and time, location of the session (if entered ), price, status, and cancellation or refund history. For Counselors, we keep records of Leads delivered, the five (5) complimentary Leads used, and Lead credits purchased and used.
2.13 Communications with us. When you contact us by email, phone, the website contact form , or in-app support, we collect your name , contact details, and what you tell us .
2.14 Surveys, promotions, and marketing preferences. If you take part in a survey or promotion or sign up for updates, we collect your responses and your marketing preferences.
3.1 Device and usage information. When you use the Services, we and our service providers automatically collect certain information, such as device type, operating system and version, app version , device identifiers , IP address, browser type, language, time zone, pages or screens viewed, features used, searches within the Services, and the date and time of your activity.
3.2 Crash and performance data . We collect crash logs and diagnostic data to find and fix bugs . This may be done through the crash -reporting tools built into iOS and Android or through service providers that help us monitor app performance.
3.3 Location . We use the ZIP code or area you enter to show Providers near you, and we may estimate a general location (such as city or region) from your IP address. If the app asks for permission to use your device's location, we use it only to show nearby Providers and related features, and only if you allow it. You can turn off location access at any time in your device settings; the Services will still work, but you may need to enter a ZIP code. We do not share a user's precise device location with other users or use it for advertising.
3.4 Push notifications . If you allow push notifications, we collect a device token so we can send you messages about bookings, messages, and your account. Notifications are delivered through the notification services of Apple or Google and service providers that help us send them. You can turn off push notifications at any time in your device settings.
3.5 Analytics . We and our service providers may use analytics tools to understand how the website, web app, and mobile apps are used, measure traffic, and improve the Services. On our website, these tools may use cookies. See Section 22.
3.6 Cookies . Our website and web app use cookies and similar technologies . See Section 22.
4.1 Stripe . If you use Stripe for payments or payouts, Stripe tells us whether a payment succeeded, the amount, the last four digits and brand of the card, and similar limited details. For Providers, Stripe tells us the status of your Stripe connected account (for example, whether it is verified and able to receive payouts). Stripe collects your identity, tax, and bank details directly under its own privacy policy .
4.2 Apple and Google. When you buy a subscription or Lead credits in the app, Apple or Google tells us about the transaction (for example, the product , price, date, renewal and cancellation status, and a transaction ID ). We do not receive your card number or Apple ID/Google account password. Where required by law (including the Texas App Store Accountability Act), Apple or Google may also give us an age category for the user and whether a parent has consented to the app or a purchase. We use that information only to verify age, obtain or confirm parental consent, apply age -appropriate settings, and comply with the law.
4.3 Background-check vendor (if and when offered). We do not currently use a background -check vendor or receive background -check information. If we add background screening in the future, it will work as described in Section 13.
4.4 Public sources. We may collect information from public license lookups, public sex offender registries, and other public records to verify Providers and protect users.
4.5 Other users. Other users may give us information about you — for example, a Parent writing a review of a Provider , a user reporting a safety concern, or a Parent adding a child to their account.
4.6 Social media links. When a Provider adds a link to an Instagram, Facebook, or other page, we store the link and may display content that the link previews. We do not ask for your social media password and do not access your social media accounts . If we offer sign-in through a third -party account (such as Apple or Google) and you choose to use it, we receive basic information from that service, such as your name and email address, as allowed by your settings with that service.
5.1 Device permissions. The app may ask for permission to use certain features of your device, such as your camera or photo library (for example, to add a profile photo), location, or notifications. Where your device requires it, we ask for your permission before using these features , we use them only for the purposes described in this policy, and you can change your permissions at any time in your device settings. Some features may not work if you turn a permission off.
5.2 No full card numbers . We do not collect or store full payment card numbers or bank account numbers. Those are handled by Stripe, Apple, or Google.
5.3 No health records. We do not ask for medical, mental health, or other health records, and the Services are not designed to hold them. Please do not upload or send them (see Section 15).
5.4 No Social Security numbers stored by us . Social Security numbers and similar information needed for Stripe identity verification are collected directly by Stripe under its own privacy policy. We do not ask you to send us your Social Security number.
We use the information described above to :
We may also create de -identified or aggregated information (for example, "number of Parents searching for football coaches in Bell County") that does not identify any person. We keep de -identified information in de -identified form and do not try to re -identify it.
We do not use information about children or teens for targeted advertising, for building marketing profiles, or for selling data. We do not make decisions that produce legal or similarly significant effects about you based solely on automated processing.
7.1 Provider profiles are public . Provider profiles, including name, business name, photo, bio, services , prices, credentials and badges, Ad Board content, social links, and reviews, can be seen by anyone who uses the Services and may be visible on our website or to search engines.
7.2 Parent, Athlete, and minor information. Parent and Athlete profiles, and accounts of users under 18, are not public listings like Provider profiles. When a Parent contacts, messages, or books a Provider (or a Counselor receives a Lead), that Provider can see the information needed to respond, such as the Parent's name and contact details and relevant Athlete profile information. Please share only what a Provider needs.
7.3 Reviews . Reviews you post appear on the Provider's profile with your name or display name , which may be shortened. Do not include a minor's full name, photo, school, or other identifying details in a review.
7.4 Messages . Messages are visible to the people in the conversation, to a linked parent where our parent tools allow it (see Sections 11.7 and 12 .4), and to MyAthlete360 as described in Section 15.
We share personal information only as described below. We do not sell personal data .
| Who receives it | What they receive | Why |
|---|---|---|
| Other users (Providers and Parents) | Profile, message, Booking, Lead, and review information, as described in Section 7 | Because you asked us to connect you — this is how the marketplace works |
| Stripe, Inc . | Payment, payout, Booking, and transaction details; for Providers, business and identity details needed for a Stripe connected account | Payment processing, payouts, fraud prevention, and legal compliance (Stripe also uses data under its own privacy policy) |
| Apple and Google | Purchase and subscription information, and age and parental-consent signals where required by law | Processing in-app purchases and complying with app store rules and laws |
| Background -check screening companies (if and when offered ; not used today ) | Provider name and information needed to run the check, only with the Provider's separate written consent | Provider screening |
| Hosting and cloud providers | All categories of data we store | Storing data and running the Services |
| Other service providers (such as email delivery, push notifications, crash reporting, analytics , security and anti -spam tools like Google reCAPTCHA, and customer support ) | The information needed for their service | Operating, securing, and improving the Services |
| Our app developers and IT contractors | Access as needed to build, maintain, and support the Services | Development and support |
| Law enforcement, NCMEC, child protective services, licensing boards, courts | Information we reasonably believe is required or appropriate | Legal compliance and protecting users, especially minors (see 8.2) |
| A buyer or successor business | Information we hold, subject to this policy | Business transfer (see 8.3) |
8.1 Service providers. Our service providers may use personal information only to perform services for us, under contracts that require them to protect it and not use it for their own purposes, except where a provider (such as Stripe, Apple, or Google) acts under its own privacy policy for its own services.
8.2 Legal and safety reasons . We may preserve and disclose information if we believe in good faith that it is reasonably necessary to (a) comply with a law, subpoena, court order, or other legal process; (b) protect the safety of any person, especially a minor; (c) report suspected child abuse or exploitation, including to NCMEC's CyberTipline or the Texas Department of Family and Protective Services; (d) investigate or prevent fraud, security issues, or violations of our Terms; or (e) protect the rights and property of MyAthlete360, our users, or the public .
8.3 Business transfers. If MyAthlete360 is involved in a merger , acquisition, financing, reorganization, bankruptcy, or sale of all or part of its assets, information may be transferred as part of that deal. The buyer or successor must honor this policy for information collected under it, or give you notice and any choices required by law.
8.4 With your consent. We may share information for other purposes if you ask us to or agree to it.
8.5 De -identified information. We may share de -identified or aggregated information that cannot reasonably be used to identify you .
9.1 No sale . We do not sell personal data, and we have not sold personal data in the past 12 months. We do not rent or trade your information to data brokers or marketers.
9.2 No targeted advertising to minors. We do not show targeted advertising (ads selected based on a person's activity across other companies' apps or websites) to anyone we know is under 18, and we do not use information about children or teens to build advertising profiles .
9.3 Ad Board ads are not targeted using your personal information. The ads on Provider Ad Boards are chosen by Providers to promote their own services, and we do not use your personal information to target Ad Board ads to you based on your activity on other companies' apps or websites.
9.4 Mobile phone numbers . We do not share mobile phone numbers or text -message opt-in data with third parties for their marketing purposes.
10.1 What the Ad Board is. The Ad Board is space on each Provider's profile (currently up to four ad slots) where Providers promote their own camps, clinics, programs, and services. If a Provider buys a paid advertising plan, the Provider's ads may also appear in other parts of the Services, and ads may be shown based on general factors such as location or sport. Ads are not targeted to you based on your activity on other companies' apps or websites.
10.2 Information in ads . Ads are public, like the rest of a Provider's profile. Providers must have written parental permission before including any image or name of a minor in an ad.
10.3 Clicking on ads. If you click a link in an ad, you may leave the Services and go to a Provider's website or social media page, which has its own privacy practices. We may count views and clicks on ads to report performance to Providers in aggregate, but we do not give Providers your identity just because you viewed or clicked an ad.
11.1 Our age line is stricter than the law's . The federal Children's Online Privacy Protection Act (" COPPA ") protects children under 13. MyAthlete360 draws its line at 14: we apply this Section to every user who selects "Under 14" and to every child under 14 in a Parent -managed profile, including 13-year -olds.
11.2 COPPA . We comply with COPPA and the Federal Trade Commission's COPPA Rule, including the amendments that took effect in 2025 and became mandatory on April 22, 2026.
11.3 How a child can appear on MyAthlete360 . There are two ways:
11.4 Parental consent comes first . When a child selects "Under 14," we collect only the information needed to contact a parent and ask for consent (such as the child's first name and the parent's email address or mobile number), and we use it only for that purpose. We then send the parent a direct notice explaining what we collect from children, how we use and share it, and how to give or refuse consent. Until the parent gives verifiable consent, we do not activate the child's account or let the child create a profile, upload photos, message anyone, post content, or share information with Providers. If we do not receive consent within a reasonable time, we delete the information we collected from the child and the parent's contact details.
11.5 How we verify consent . We verify that the person giving consent is the child's parent or guardian using a method permitted by the FTC's COPPA Rule , which we will explain to the parent when we ask for consent.
11.6 What we collect after consent. After a parent consents, we collect only what is reasonably necessary for the child to take part: first name or initials, age band, sports or subjects of interest , skill level, and ZIP code, plus login details if the child has their own login. We do not ask children under 14 for an email address, phone number, photo, school name, or precise location . If a child's login needs an email address, we use the parent's email address. We do not condition a child's participation on giving more information than is reasonably necessary .
11.7 What children under 14 can do. Children under 14 can use only the features we make available for their age group. Children under 14 cannot make purchases or Bookings without the Parent, and Providers may not message them directly; Providers communicate with the Parent.
11.8 How we use and share children's information. We use a child's information only to provide the Services to the child and Parent — for example , to match the family with suitable Providers and to share the relevant profile details with a Provider the Parent chooses to contact or book. We do not use children's information for advertising, and we do not sell it or disclose it to third parties except (a) to Providers the Parent chooses, (b) to service providers that support the Services under confidentiality and security obligations , and (c) for the legal and safety reasons in Section 8 .2. We do not disclose children's information to third parties for purposes that are not integral to the Services, such as targeted advertising .
11.9 Parents' rights. A parent may at any time:
You can do these things in the app or by contacting us at contact@myathlete36 0.net or 254-278-7799. We will verify that you are the child's parent before acting on a request made outside the app.
11.10 Children's data retention and security. We keep a child's information only as long as reasonably necessary to provide the Services, and we delete it when the parent deletes the child's account or profile, revokes consent, or deletes the Parent account, subject to the limited exceptions in Section 20. We protect children's information using the safeguards described in Section 21.
11.11 If we learn a child's age is wrong. If we learn that we collected personal information from a child under 14 without verified parental consent — for example, because a child selected "14–17" or "18 or older" — we will stop collecting from that child, suspend the account, and either obtain verifiable parental consent or promptly delete the information. If you believe this has happened, contact us at contact@myathlete36 0.net.
12.1 How teen accounts work . A teen selects "I'm between 14 and 17 years old" at signup, creates a login, and enters a parent or guardian's contact information. We send that parent an invitation. The parent joins by selecting "Invited parent " ("My teen asked me to join as their guardian"), confirms that they are the teen's parent or legal guardian, agrees to our Terms, and consents to the teen's use of the Services. The teen's account is then linked to the parent's account.
12.2 Before the parent accepts . Until a parent accepts the invitation, the teen's account stays in a limited mode, and features such as messaging with Providers, Bookings, and purchases are restricted. If no parent accepts within a reasonable time, we may delete the pending account and the parent's contact details. We use the parent contact information the teen gives us only to send the invitation and related reminders .
12.3 Verifying the invited parent . We ask the invited parent to confirm their relationship to the teen, and we may take additional reasonable steps to verify it. If we learn that the person who accepted is not the teen's parent or guardian, we may suspend the teen's account until a real parent or guardian approves it .
12.4 Parent tools. A linked parent can use the parent tools available in the app to supervise the teen's account, which may include viewing the teen's profile and Bookings , managing settings, approving or blocking purchases and Bookings, and limiting features. A linked parent can revoke consent or have the teen's account deleted at any time, in the app or by contacting us. A parent can also contact us to request access to, correction of, or deletion of the teen's information .
12.5 Protections for known minors . For anyone we know is under 18 (including every user in the Under 14 and 14–17 bands), we:
12.6 Texas SCOPE Act. Texas's Securing Children Online through Parental Empowerment Act (HB 18, Texas Business & Commerce Code Chapter 509) protects "known minors" (under 18). Because users tell us their age band at signup, teens in the 14–17 band (and children under 14) are known minors to us. The law gives verified parents of known minors rights to access, supervise , and control certain settings and data, and limits data collection, targeted advertising , and financial transactions for known minors. We comply with this law to the extent it applies to us. Whether or not the law applies, parents may use the tools in Section 12.4 and contact us to request access to, or deletion of, a minor's information .
12.7 App store age signals (Texas App Store Accountability Act ). Under Texas's App Store Accountability Act (SB 2420), Apple and Google may tell us a user's age category and whether a parent has consented. We use that information only to apply age requirements, obtain or confirm parental consent, and comply with law; we do not use it for advertising, and we keep it only as long as needed for those purposes. If the app store's age signal conflicts with the age band a user chose, we may apply the younger age or ask for parent confirmation. If we make a significant change to the app, we may need to obtain parental consent again for minor users.
12.8 Turning 18. When a teen turns 18, we may convert the account to an adult account and end the parent link, and we may notify the linked parent.
13.1 Credential review today. We currently review the credentials that Providers submit, such as licenses and certifications (for example, counselor licenses and coaching certifications), and may confirm licenses using public license lookups (see Section 2.6). This review is limited, relies on documents and public records that can be incomplete or out of date, and does not guarantee a Provider's safety or the quality of their services.
13.2 No background checks at this time. We do not currently run background checks on Providers or collect information for background checks .
13.3 If we add background screening. If we add background screening in the future, it will be done by a third -party screening company only with the Provider's separate written consent, and we will update this Privacy Policy before it begins.
13.4 How we use credential information. We use credential information to decide whether a Provider may be listed or display a credential or badge. We limit access to copies of credential documents to personnel who need them for these purposes, and we do not show those copies to Parents. We may display on a Provider's profile that a credential was reviewed and the date.
13.5 Retention. We keep credential and license information only as long as needed for the purposes described in this Section and as required or allowed by law, then securely delete it .
14.1 Bookings and web purchases (Stripe). Payments for Bookings, and subscription or Lead credit purchases on our website or web app, are processed by Stripe, Inc. Your card details are entered into Stripe's secure payment form and sent directly to Stripe. We do not see or store your full card number. We receive limited information from Stripe (see Section 4.1). Stripe's privacy policy is at https ://stripe.com /privacy.
14.2 Provider payouts (Stripe Connect). To receive Booking payments, Providers create a Stripe connected account. Stripe collects identity, tax, and bank information directly to verify the Provider and send payouts. We share with Stripe the business and transaction information needed to enable payouts, as described in our Terms.
14.3 In-app purchases (Apple and Google). Subscriptions and Lead credits bought inside the iOS or Android app are processed by Apple or Google under their privacy policies. We receive transaction and subscription status only.
14.4 Records . We keep records of purchases , Bookings, refunds, and chargebacks as needed for accounting, tax, and legal purposes (see Section 20).
15.1 Messages are not confidential from MyAthlete360 . We store messages and may review, scan, and keep them — using automated tools and human review — to protect users (especially minors), investigate reports, enforce our Terms, and comply with law. We do not monitor messages in real time. MyAthlete360 is not an emergency service . If someone is in danger, call 911. For a mental health crisis, call or text 988.
15.2 Not HIPAA-compliant; not for counseling . MyAthlete360 is not a healthcare provider or a HIPAA "covered entity," and our messaging is not designed to protect health information. Counselors must not use in-app messaging to deliver counseling or to exchange protected health information, and Parents should not share medical, mental health, diagnosis, or treatment details through the Services . Use the Counselor's own secure, confidential channels instead.
15.3 Sensitive information. We do not ask for sensitive personal data such as health diagnoses, race or ethnicity, religion, sexual orientation, immigration status, or precise location of a child. If you choose to include sensitive information in your profile or messages, you are choosing to share it with the recipients and with us. Under Texas law, personal data collected from a known child under 13 is "sensitive data"; we process it (and all data of children under 14) only as described in Section 11, with parental consent.
16.1 Account and profile information. You can review and update most of your information in your profile and account settings in the app .
16.2 Marketing emails and texts. You can unsubscribe from marketing emails by using the link in the email, or by contacting us. If we send you marketing text messages, you can reply STOP to stop them. We will still send service messages, such as security, booking, and billing notices .
16.3 Push notifications . You can turn off push notifications in your device settings .
16.4 Location and other device permissions. You can turn off location access and other device permissions in your device settings.
16.5 Cookies . You can control cookies through your browser settings (see Section 22).
16.6 Parental controls. Parents can manage Athlete profiles, children's accounts, and linked teen accounts as described in Sections 11.9 and 12 .4.
17.1 In the app. You can delete your account at any time using the account deletion option in the app's account settings.
17.2 By email (no app needed ). You can also request deletion by emailing contact@myathlete36 0.net from the email address on your account with the subject "Delete My Account." We may ask you to confirm your identity.
17.3 What happens. When you delete your account, we delete or de-identify your personal information , including any Athlete profiles in your account, within a reasonable period, except information we must or may keep for the reasons in Section 20 (for example, transaction records for tax purposes, safety reports and records of removed Providers , and backup copies that are overwritten on a regular schedule). Reviews you posted may be deleted or may remain in de -identified form.
17.4 Subscriptions . Deleting the app or your account does not cancel an Apple or Google subscription . Cancel in your Apple or Google account settings first (see our Terms , Section 19.5).
17.5 Minor accounts. A parent can delete a linked child's or teen's account in the app or by contacting us. A teen can also contact us to ask that their own account be deleted, and we may notify the linked parent .
17.6 Information others have. Deleting your account does not delete information a Provider or Parent already received from you (for example, a message they received or information a Provider keeps in its own records). Contact that person directly.
18.1 Texas Data Privacy and Security Act . If you are a Texas resident , the Texas Data Privacy and Security Act ("TDPSA ") may give you the right to:
18.2 How to make a request . Email contact@myathlete36 0.net with the subject "Privacy Request," or call 254 -278-7799. A Parent may make a request for their child. You may also use an authorized agent where the law allows. We will verify your identity (usually by confirming control of your account email) before responding, and we will not ask for more information than we need.
18.3 Timing and cost. We will respond within 45 days, and may extend by another 45 days when reasonably necessary , with notice. Requests are free up to twice a year; we may charge a reasonable fee or decline requests that are clearly unfounded, excessive , or repetitive, as the law allows.
18.4 Appeals . If we decline your request , you may appeal by replying to our decision or emailing contact@myathlete36 0.net with the subject "Privacy Appeal." We will respond within 60 days. If you are not satisfied with our answer, you may contact the Texas Attorney General at https://www .texasattorneygenera l.gov/consumer -protection/file -consumer-complaint .
18.5 No discrimination . We will not deny you service , charge you a different price, or give you a lower quality of service because you exercised your privacy rights.
Depending on where you live, other state laws may give you similar rights, such as the right to access, correct, delete, or get a copy of your personal information , and to opt out of sale, targeted advertising, or certain profiling. We will honor requests as required by the law that applies to you, using the process in Section 18.
We keep personal information only as long as needed for the purposes described in this policy, and then we delete or de -identify it. How long we keep information depends on the type of information and why we have it. For example:
We may keep information longer if required by law or needed to resolve disputes, enforce our agreements, or respond to legal process (for example , a litigation hold or law-enforcement preservation request ).
21.1 Our safeguards. We use reasonable administrative, technical, and physical safeguards designed to protect personal information , including encryption in transit (HTTPS/TLS), access controls that limit employee and contractor access to those who need it, and service providers with strong security practices.
21.2 No guarantee. No system is completely secure. Please use a strong, unique password and tell us right away at contact@myathlete36 0.net if you believe your account has been compromised .
21.3 Breach notice. If a security breach affects your personal information , we will notify you and the authorities as required by law (including the Texas Identity Theft Enforcement and Protection Act).
22.1 What cookies are. Cookies are small files placed on your browser. Similar technologies include pixels, tags, and local storage.
22.2 What we use. Our website and web app may use:
Where these tools are provided by third parties, their own privacy policies also apply.
22.3 Your choices. You can block or delete cookies in your browser settings. If you block essential cookies, parts of the web app may not work.
23.1 Do Not Track. Some browsers send a "Do Not Track" signal. Because there is no common standard for responding to these signals, our website does not currently respond to them.
23.2 Global Privacy Control . Some browsers and extensions send a Global Privacy Control ("GPC") signal. Where required by applicable law, we treat a valid GPC signal as a request to opt out of the sale of personal data and targeted advertising for that browser. Because we do not sell personal data, this does not change how the Services work.
The Services link to or work with services we do not control, including Instagram and Facebook (Meta Platforms, Inc.), Providers' websites, Stripe, Apple, and Google. Their privacy policies — not this one — govern how they collect and use your information. Please review them before sharing information .
The Services are intended for people in the United States . If you use them from another country , your information will be processed and stored in the United States, where privacy laws may differ from those in your country.
We may update this policy from time to time. If we make material changes, we will notify you by email, in-app notice , or a notice on the Services at least 30 days before the changes take effect, unless a change is required sooner by law or for safety. If a change would let us use children's information in a materially different way, we will obtain Parent consent first where required by law. The "Last updated" date at the top shows when this policy last changed .

This Privacy Policy takes effect on the date shown above.
This Privacy Policy explains how MyAthlete360 LLC ("MyAthlete360," "we," "us," or "our") collects, uses, shares, and protects information about you when you use the MyAthlete360 mobile app for iOS and Android, the website at https://myathlete360.net, the web app at https://pro.myathlete360.net, and any related features or services (together, the "Services"). It is part of, and uses the same defined terms as, our Terms of Service at https://myathlete360.net/terms-of-service/ (for example, "Parent," "Athlete," "Provider," "Counselor," "Lead," "Ad Board," and "Booking").
1.1 Who we are. MyAthlete360 LLC is located at 3809 S General Bruce Dr, Ste 103, Temple, TX 76502. You can reach us at contact@myathlete360.net or 254-278-7799. We are responsible for the personal information described in this policy.
1.2 What we do. MyAthlete360 is a marketplace and advertising platform that helps Parents and adult athletes find local Providers, mainly in Central Texas. We are not a coaching, training, tutoring, counseling, or healthcare provider. Providers are independent businesses, and when a Provider receives your information through the Services, the Provider's own privacy practices also apply to how the Provider uses it.
1.3 What this policy covers. This policy covers information we collect through the Services, and when you email, call, or otherwise communicate with us. It does not cover:
1.4 Replaces the prior policy. This policy replaces all earlier versions of the MyAthlete360 privacy policy.
2.1 Account information (all users). When you create an account, we collect your name, email address, phone number, password, account type (Parent/Athlete, Coach/Trainer, Tutor, or Counselor), and ZIP code or address. Users under 18 may create an account only as described in Sections 2.4, 11, and 12.
2.2 Signup role and age band. When you sign up, you first choose how you are registering: Parent/Athlete, Coach/Trainer, Tutor, or Counselor. If you choose Parent/Athlete, you then tell us who you are:
We use your answer (your "age band") to decide what information we may collect, what parental consent we need, and which features you can use.
2.5 Provider profile information. If you are a Provider, we collect the information you put on your profile, such as your name, business name, profile photo, bio, the services you offer, sports or subjects, ages you work with, experience, education, service area, prices, availability, and links to your Instagram, Facebook, website, or other pages.
2.6 Credentials, licenses, and verification. Providers may give us certifications, license type and number, issuing state or agency, expiration dates, proof of insurance, and copies or photos of these documents. We may confirm this information using public license lookups (for example, the Texas Behavioral Health Executive Council). If we ask a Provider to complete identity verification, the Provider may be asked for identity information, which may be collected by us or by a service provider that performs the verification for us.
2.7 Background-check information (if and when offered). We do not currently run background checks or collect background-check information. See Section 13.
2.8 Payment and purchase information. Card and bank details for Bookings and web purchases are collected and processed by Stripe, and in-app subscription and Lead credit purchases are processed by Apple or Google. We do not receive or store full card numbers. See Section 14.
2.9 Messages. When you use in-app messaging, we collect the content of your messages (including any photos or files you attach, where supported), who sent and received them, and when.
2.10 Reviews, ratings, and reports. We collect reviews and ratings you post, and any reports you make to us about safety concerns, content, or other users, including reports you submit with the Report button in the app (such as the report details, the user or content reported, and when you sent it).
2.11 Ad Board content and other User Content. We collect the ads, photos, videos (where supported), text, links, and other content that Providers post on their Ad Board or profile, and any other content you submit.
2.12 Bookings and Leads. When a Parent books a session or contacts a Provider, we collect the details of that request, such as the Provider, service, date and time, location of the session (if entered), price, status, and cancellation or refund history. For Counselors, we keep records of Leads delivered, the five (5) complimentary Leads used, and Lead credits purchased and used.
2.13 Communications with us. When you contact us by email, phone, the website contact form, or in-app support, we collect your name, contact details, and what you tell us.
2.14 Surveys, promotions, and marketing preferences. If you take part in a survey or promotion or sign up for updates, we collect your responses and your marketing preferences.
3.1 Device and usage information. When you use the Services, we and our service providers automatically collect certain information, such as device type, operating system and version, app version, device identifiers, IP address, browser type, language, time zone, pages or screens viewed, features used, searches within the Services, and the date and time of your activity.
3.2 Crash and performance data. We collect crash logs and diagnostic data to find and fix bugs. This may be done through the crash-reporting tools built into iOS and Android or through service providers that help us monitor app performance.
3.3 Location.
3.4 Push notifications. If you allow push notifications, we collect a device token so we can send you messages about bookings, messages, and your account. Notifications are delivered through the notification services of Apple or Google and service providers that help us send them. You can turn off push notifications at any time in your device settings.
3.5 Analytics. We and our service providers may use analytics tools to understand how the website, web app, and mobile apps are used, measure traffic, and improve the Services. On our website, these tools may use cookies. See Section 22.
3.6 Cookies. Our website and web app use cookies and similar technologies. See Section 22.
4.1 Stripe. If you use Stripe for payments or payouts, Stripe tells us whether a payment succeeded, the amount, the last four digits and brand of the card, and similar limited details. For Providers, Stripe tells us the status of your Stripe connected account (for example, whether it is verified and able to receive payouts). Stripe collects your identity, tax, and bank details directly under its own privacy policy.
4.2 Apple and Google. When you buy a subscription or Lead credits in the app, Apple or Google tells us about the transaction (for example, the product, price, date, renewal and cancellation status, and a transaction ID). We do not receive your card number or Apple ID/Google account password. Where required by law (including the Texas App Store Accountability Act), Apple or Google may also give us an age category for the user and whether a parent has consented to the app or a purchase. We use that information only to verify age, obtain or confirm parental consent, apply age-appropriate settings, and comply with the law.
4.3 Background-check vendor (if and when offered). We do not currently use a background-check vendor or receive background-check information. If we add background screening in the future, it will work as described in Section 13.
4.4 Public sources. We may collect information from public license lookups, public sex offender registries, and other public records to verify Providers and protect users.
4.5 Other users. Other users may give us information about you — for example, a Parent writing a review of a Provider, a user reporting a safety concern, or a Parent adding a child to their account.
4.6 Social media links. When a Provider adds a link to an Instagram, Facebook, or other page, we store the link and may display content that the link previews. We do not ask for your social media password and do not access your social media accounts. If we offer sign-in through a third-party account (such as Apple or Google) and you choose to use it, we receive basic information from that service, such as your name and email address, as allowed by your settings with that service.
5.1 Device permissions. The app may ask for permission to use certain features of your device, such as your camera or photo library (for example, to add a profile photo), location, or notifications. Where your device requires it, we ask for your permission before using these features, we use them only for the purposes described in this policy, and you can change your permissions at any time in your device settings. Some features may not work if you turn a permission off.
5.2 No full card numbers. We do not collect or store full payment card numbers or bank account numbers. Those are handled by Stripe, Apple, or Google.
5.3 No health records. We do not ask for medical, mental health, or other health records, and the Services are not designed to hold them. Please do not upload or send them (see Section 15).
5.4 No Social Security numbers stored by us. Social Security numbers and similar information needed for Stripe identity verification are collected directly by Stripe under its own privacy policy. We do not ask you to send us your Social Security number.
We use the information described above to:
We may also create de-identified or aggregated information (for example, "number of Parents searching for football coaches in Bell County") that does not identify any person. We keep de-identified information in de-identified form and do not try to re-identify it.
We do not use information about children or teens for targeted advertising, for building marketing profiles, or for selling data. We do not make decisions that produce legal or similarly significant effects about you based solely on automated processing.
7.1 Provider profiles are public. Provider profiles, including name, business name, photo, bio, services, prices, credentials and badges, Ad Board content, social links, and reviews, can be seen by anyone who uses the Services and may be visible on our website or to search engines.
7.3 Reviews. Reviews you post appear on the Provider's profile with your name or display name, which may be shortened. Do not include a minor's full name, photo, school, or other identifying details in a review.
7.4 Messages. Messages are visible to the people in the conversation, to a linked parent where our parent tools allow it (see Sections 11.7 and 12.4), and to MyAthlete360 as described in Section 15.
We share personal information only as described below. We do not sell personal data.
| Who receives it | What they receive | Why |
|---|---|---|
| Other users (Providers and Parents) | Profile, message, Booking, Lead, and review information, as described in Section 7 | Because you asked us to connect you — this is how the marketplace works |
| Stripe, Inc.
| Background-check screening companies (if and when offered; not used today) | Provider name and information needed to run the check, only with the Provider's separate written consent | Provider screening |
| Hosting and cloud providers | All categories of data we store | Storing data and running the Services |
| Other service providers (such as email delivery, push notifications, crash reporting, analytics, security and anti-spam tools like Google reCAPTCHA, and customer support) | The information needed for their service | Operating, securing, and improving the Services |
8.2 Legal and safety reasons. We may preserve and disclose information if we believe in good faith that it is reasonably necessary to (a) comply with a law, subpoena, court order, or other legal process; (b) protect the safety of any person, especially a minor; (c) report suspected child abuse or exploitation, including to NCMEC's CyberTipline or the Texas Department of Family and Protective Services; (d) investigate or prevent fraud, security issues, or violations of our Terms; or (e) protect the rights and property of MyAthlete360, our users, or the public.
8.3 Business transfers. If MyAthlete360 is involved in a merger, acquisition, financing, reorganization, bankruptcy, or sale of all or part of its assets, information may be transferred as part of that deal. The buyer or successor must honor this policy for information collected under it, or give you notice and any choices required by law.
8.4 With your consent. We may share information for other purposes if you ask us to or agree to it.
8.5 De-identified information. We may share de-identified or aggregated information that cannot reasonably be used to identify you.
9.1 No sale. We do not sell personal data, and we have not sold personal data in the past 12 months. We do not rent or trade your information to data brokers or marketers.
9.2 No targeted advertising to minors. We do not show targeted advertising (ads selected based on a person's activity across other companies' apps or websites) to anyone we know is under 18, and we do not use information about children or teens to build advertising profiles.
9.3 Ad Board ads are not targeted using your personal information. The ads on Provider Ad Boards are chosen by Providers to promote their own services, and we do not use your personal information to target Ad Board ads to you based on your activity on other companies' apps or websites.
9.4 Mobile phone numbers. We do not share mobile phone numbers or text-message opt-in data with third parties for their marketing purposes.
10.2 Information in ads.
11.1 Our age line is stricter than the law's. The federal Children's Online Privacy Protection Act ("COPPA") protects children under 13. MyAthlete360 draws its line at 14: we apply this Section to every user who selects "Under 14" and to every child under 14 in a Parent-managed profile, including 13-year-olds.
11.2 COPPA. We comply with COPPA and the Federal Trade Commission's COPPA Rule, including the amendments that took effect in 2025 and became mandatory on April 22, 2026.
11.3 How a child can appear on MyAthlete360. There are two ways:
11.4 Parental consent comes first.
11.5 How we verify consent. We verify that the person giving consent is the child's parent or guardian using a method permitted by the FTC's COPPA Rule, which we will explain to the parent when we ask for consent.
11.6 What we collect after consent. After a parent consents, we collect only what is reasonably necessary for the child to take part: first name or initials, age band, sports or subjects of interest, skill level, and ZIP code, plus login details if the child has their own login. We do not ask children under 14 for an email address, phone number, photo, school name, or precise location. If a child's login needs an email address, we use the parent's email address. We do not condition a child's participation on giving more information than is reasonably necessary.
11.7 What children under 14 can do. Children under 14 can use only the features we make available for their age group. Children under 14 cannot make purchases or Bookings without the Parent, and Providers may not message them directly; Providers communicate with the Parent.
11.8 How we use and share children's information. We use a child's information only to provide the Services to the child and Parent — for example, to match the family with suitable Providers and to share the relevant profile details with a Provider the Parent chooses to contact or book. We do not use children's information for advertising, and we do not sell it or disclose it to third parties except (a) to Providers the Parent chooses, (b) to service providers that support the Services under confidentiality and security obligations, and (c) for the legal and safety reasons in Section 8.2. We do not disclose children's information to third parties for purposes that are not integral to the Services, such as targeted advertising.
11.9 Parents' rights. A parent may at any time:
You can do these things in the app or by contacting us at contact@myathlete360.net or 254-278-7799.
If you believe this has happened, contact us at contact@myathlete360.net.
12.1 How teen accounts work. A teen selects "I'm between 14 and 17 years old" at signup, creates a login, and enters a parent or guardian's contact information. We send that parent an invitation. The parent joins by selecting "Invited parent" ("My teen asked me to join as their guardian"), confirms that they are the teen's parent or legal guardian, agrees to our Terms, and consents to the teen's use of the Services. The teen's account is then linked to the parent's account.
12.2 Before the parent accepts. Until a parent accepts the invitation, the teen's account stays in a limited mode, and features such as messaging with Providers, Bookings, and purchases are restricted. If no parent accepts within a reasonable time, we may delete the pending account and the parent's contact details. We use the parent contact information the teen gives us only to send the invitation and related reminders.
12.3 Verifying the invited parent. We ask the invited parent to confirm their relationship to the teen, and we may take additional reasonable steps to verify it. If we learn that the person who accepted is not the teen's parent or guardian, we may suspend the teen's account until a real parent or guardian approves it.
12.4 Parent tools. A linked parent can use the parent tools available in the app to supervise the teen's account, which may include viewing the teen's profile and Bookings, managing settings, approving or blocking purchases and Bookings, and limiting features. A linked parent can revoke consent or have the teen's account deleted at any time, in the app or by contacting us. A parent can also contact us to request access to, correction of, or deletion of the teen's information.
12.5 Protections for known minors.
The law gives verified parents of known minors rights to access, supervise, and control certain settings and data, and limits data collection, targeted advertising, and financial transactions for known minors. We comply with this law to the extent it applies to us. Whether or not the law applies, parents may use the tools in Section 12.4 and contact us to request access to, or deletion of, a minor's information.
12.7 App store age signals (Texas App Store Accountability Act).
We do not currently run background checks on Providers or collect information for background checks.
13.3 If we add background screening. If we add background screening in the future, it will be done by a third-party screening company only with the Provider's separate written consent, and we will update this Privacy Policy before it begins.
We keep credential and license information only as long as needed for the purposes described in this Section and as required or allowed by law, then securely delete it.
Stripe's privacy policy is at https://stripe.com/privacy.
14.4 Records. We keep records of purchases, Bookings, refunds, and chargebacks as needed for accounting, tax, and legal purposes (see Section 20).
15.1 Messages are not confidential from MyAthlete360. We store messages and may review, scan, and keep them — using automated tools and human review — to protect users (especially minors), investigate reports, enforce our Terms, and comply with law. We do not monitor messages in real time. MyAthlete360 is not an emergency service. If someone is in danger, call 911. For a mental health crisis, call or text 988.
15.2 Not HIPAA-compliant; not for counseling. MyAthlete360 is not a healthcare provider or a HIPAA "covered entity," and our messaging is not designed to protect health information. Counselors must not use in-app messaging to deliver counseling or to exchange protected health information, and Parents should not share medical, mental health, diagnosis, or treatment details through the Services.
You can review and update most of your information in your profile and account settings in the app.
16.2 Marketing emails and texts. You can unsubscribe from marketing emails by using the link in the email, or by contacting us. If we send you marketing text messages, you can reply STOP to stop them. We will still send service messages, such as security, booking, and billing notices.
16.3 Push notifications. You can turn off push notifications in your device settings.
16.4 Location and other device permissions. You can turn off location access and other device permissions in your device settings.
16.5 Cookies. You can control cookies through your browser settings (see Section 22).
16.6 Parental controls. Parents can manage Athlete profiles, children's accounts, and linked teen accounts as described in Sections 11.9 and 12.4.
17.1 In the app. You can delete your account at any time using the account deletion option in the app's account settings.
17.2 By email (no app needed). You can also request deletion by emailing contact@myathlete360.net from the email address on your account with the subject "Delete My Account." We may ask you to confirm your identity.
17.3 What happens. When you delete your account, we delete or de-identify your personal information, including any Athlete profiles in your account, within a reasonable period, except information we must or may keep for the reasons in Section 20 (for example, transaction records for tax purposes, safety reports and records of removed Providers, and backup copies that are overwritten on a regular schedule). Reviews you posted may be deleted or may remain in de-identified form.
17.4 Subscriptions. Deleting the app or your account does not cancel an Apple or Google subscription. Cancel in your Apple or Google account settings first (see our Terms, Section 19.5).
17.5 Minor accounts. A parent can delete a linked child's or teen's account in the app or by contacting us. A teen can also contact us to ask that their own account be deleted, and we may notify the linked parent.
17.6 Information others have. Deleting your account does not delete information a Provider or Parent already received from you (for example, a message they received or information a Provider keeps in its own records). Contact that person directly.
18.1 Texas Data Privacy and Security Act. If you are a Texas resident, the Texas Data Privacy and Security Act ("TDPSA") may give you the right to:
18.2 How to make a request. Email contact@myathlete360.net with the subject "Privacy Request," or call 254-278-7799. A Parent may make a request for their child. You may also use an authorized agent where the law allows. We will verify your identity (usually by confirming control of your account email) before responding, and we will not ask for more information than we need.
18.3 Timing and cost. We will respond within 45 days, and may extend by another 45 days when reasonably necessary, with notice. Requests are free up to twice a year; we may charge a reasonable fee or decline requests that are clearly unfounded, excessive, or repetitive, as the law allows.
18.4 Appeals. If we decline your request, you may appeal by replying to our decision or emailing contact@myathlete360.net with the subject "Privacy Appeal." We will respond within 60 days. If you are not satisfied with our answer, you may contact the Texas Attorney General at https://www.texasattorneygeneral.gov/consumer-protection/file-consumer-complaint.
18.5 No discrimination. We will not deny you service, charge you a different price, or give you a lower quality of service because you exercised your privacy rights.
Depending on where you live, other state laws may give you similar rights, such as the right to access, correct, delete, or get a copy of your personal information, and to opt out of sale, targeted advertising, or certain profiling. We will honor requests as required by the law that applies to you, using the process in Section 18.
We keep personal information only as long as needed for the purposes described in this policy, and then we delete or de-identify it. How long we keep information depends on the type of information and why we have it. For example:
We may keep information longer if required by law or needed to resolve disputes, enforce our agreements, or respond to legal process (for example, a litigation hold or law-enforcement preservation request).
21.1 Our safeguards. We use reasonable administrative, technical, and physical safeguards designed to protect personal information, including encryption in transit (HTTPS/TLS), access controls that limit employee and contractor access to those who need it, and service providers with strong security practices.
21.2 No guarantee. No system is completely secure. Please use a strong, unique password and tell us right away at contact@myathlete360.net if you believe your account has been compromised.
21.3 Breach notice. If a security breach affects your personal information, we will notify you and the authorities as required by law (including the Texas Identity Theft Enforcement and Protection Act).
23.2 Global Privacy Control.
Please review them before sharing information.
The Services are intended for people in the United States. If you use them from another country, your information will be processed and stored in the United States, where privacy laws may differ from those in your country.
We may update this policy from time to time. If we make material changes, we will notify you by email, in-app notice, or a notice on the Services at least 30 days before the changes take effect, unless a change is required sooner by law or for safety. If a change would let us use children's information in a materially different way, we will obtain Parent consent first where required by law. The "Last updated" date at the top shows when this policy last changed.
